Welcome to SegmentFlow.ai. These Terms of Service ("Terms") govern your access to and use of the SegmentFlow.ai platform, including our website, applications, and services (collectively, the "Service").

By accessing or using SegmentFlow.ai, you agree to be bound by these Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

SegmentFlow.ai is an AI-powered email marketing platform designed for Shopify merchants. Our Service enables you to:

• Talk to your data: Describe your target audience in plain English (e.g., "Customers who bought twice but haven't opened an email in a month") and we'll build the segment instantly.
• Generate brand-aware creative: Our AI automatically uses your Shopify store's logos, product photos, and color palette to generate professional, ready-to-send email templates.
• Launch campaigns with one click: Send marketing campaigns in seconds and track real-time delivery statistics including opens, clicks, and bounces.
• Track revenue attribution: See the exact dollar amount every campaign generates by connecting email engagement to Shopify checkout data.

To use SegmentFlow.ai, you must:

• Be at least 18 years of age
• Have the legal authority to enter into these Terms on behalf of yourself or the entity you represent
• Own or have authorized access to a Shopify store
• Not be prohibited from using the Service under applicable laws

To access the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow others to access your account.

SegmentFlow.ai integrates with your Shopify store via OAuth authorization. By connecting your Shopify store, you authorize us to access the following data:

• Customer data: Names, email addresses, purchase history, and engagement metrics
• Order data: Order details, products purchased, order values, and fulfillment status
• Product data: Product names, descriptions, images, and pricing
• Store branding: Logos, color schemes, and brand assets

This data is used solely to provide the Service, including building customer segments, generating email campaigns, and tracking revenue attribution. We do not sell or share your Shopify data with third parties for their own purposes.

You represent that you have the necessary rights and permissions to share this data with SegmentFlow.ai and to send marketing communications to your customers in compliance with applicable laws.

SegmentFlow.ai uses artificial intelligence to generate customer segments and email campaign content. You acknowledge that:

• AI-generated content is created based on your store data, brand assets, and the instructions you provide
• You are responsible for reviewing all AI-generated segments and campaign content before sending
• While we strive for accuracy, AI-generated content may occasionally contain errors or inconsistencies
• You retain full editorial control and responsibility for all content sent through the Service

SegmentFlow.ai is not liable for any claims arising from AI-generated content that you choose to send without proper review.

When using SegmentFlow.ai to send marketing emails, you are responsible for compliance with all applicable email marketing laws, including but not limited to:

• The CAN-SPAM Act (United States)
• The General Data Protection Regulation (GDPR) (European Union)
• The Canadian Anti-Spam Legislation (CASL)
• Any other applicable local, national, or international laws

You agree to:

• Only send emails to recipients who have given valid consent to receive marketing communications from you
• Honor all unsubscribe requests promptly (SegmentFlow.ai provides automatic unsubscribe handling)
• Include accurate sender information and a valid physical mailing address in your emails
• Not use deceptive subject lines or misleading content
• Maintain records of consent as required by applicable laws

SegmentFlow.ai reserves the right to suspend or terminate accounts that violate email marketing laws or our anti-spam policies.

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or messages to purchased or scraped email lists
• Transmit illegal, harmful, threatening, abusive, or otherwise objectionable content
• Engage in phishing, fraud, or deceptive practices
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete with SegmentFlow.ai or build a similar product

Our Property: The Service, including all software, designs, text, graphics, and other content provided by SegmentFlow.ai, is owned by SegmentFlow.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Property: You retain all rights to your Shopify store data, customer information, and the email campaigns you create using the Service. You grant SegmentFlow.ai a limited license to use this data solely to provide and improve the Service.

Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use this feedback without restriction or compensation.

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

SegmentFlow.ai is currently in an early access phase. During this period:

• Features and functionality may change, be added, or removed without prior notice
• The Service may experience downtime for maintenance, updates, or unforeseen issues
• We do not guarantee any specific uptime or availability
• We may limit access to certain features or impose usage restrictions

We strive to provide reliable service and will communicate significant changes when possible.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

SegmentFlow.ai does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components.

We do not guarantee any specific results from using the Service, including email deliverability rates, open rates, click rates, or revenue generation.

To the maximum extent permitted by applicable law, SegmentFlow.ai and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of goodwill
• Cost of substitute services
• Any damages arising from your use or inability to use the Service

In no event shall our total liability exceed the amount you have paid to SegmentFlow.ai in the twelve (12) months preceding the claim, or one hundred euros (EUR 100), whichever is greater.

By You: You may terminate your account at any time by contacting us at hello@segmentflow.ai. Upon termination, your right to use the Service will cease immediately.

By Us: We may suspend or terminate your account at any time, with or without cause, including if we reasonably believe you have violated these Terms. We will attempt to notify you before termination when practical.

Effect of Termination: Upon termination, we will delete your account data within 30 days, unless we are required to retain it by law. You may request an export of your data before termination.

Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service before the changes take effect.

Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Estonia, unless otherwise required by applicable consumer protection laws.
